Recall Case Against Tenino Councilor Scribner Dismissed

Nov 29, 2012 (The Chronicle - McClatchy-Tribune Information Services via COMTEX) -- The recall effort against Tenino Councilor Robert Scribner was dismissed Wednesday morning in Thurston County Superior Court.

Judge Thomas McPhee ruled the Tenino Recall Committee's charge against Scribner was not factually or legally sufficient.

The committee's charges against Scribner relate to him using resources while working at the Washington State Department of Labor and Industries in June to access personal and confidential records on Mayor Eric Strawn and other council members.

Scribner also used company time at L&I to conduct city council business.

In an email sent June 20, Scribner asked another L&I employee what they knew about workers compensation for elected officials. Scribner said in the email that he started thinking about the issue "because of the Tenino mayor problems," according to the recall committee's findings and from records obtained by The Chronicle through a public records request.

Scribner, who retired as an L&I account manager on Aug. 31 due to medical reasons, said in an interview with an investigator that he looked up confidential information on Strawn because he wanted to know if Strawn was getting any other income.

Scribner also said he searched other city employees' paychecks on the L&I database.

Tenino Recall Committee Spokesperson Justin Kover said the committee plans to submitted a reconsideration to the judge.

"It didn't matter which one won," Kover said. "One of us was going to file a reconsideration. We still believe Scribner broke the law." Kover said he will bring up other information in the reconsideration including more information from L&I and the city.

The Tenino Recall Committee has 10 days to submit their request for reconsideration.
